Executive procedures of the Council for Overseeing Design, Manufacturing, Import and Distribution of Toys.

Introduction:

Based on the article 3 of the Statute of the Council Overseeing Design, Manufacturing, Import and Distribution of Toys, approved at the 422nd meeting of the Supreme Council for Cultural Revolution (SCCR) on July 6, 1998, the executive procedures of the said council herein after called "the council" are drafted for defining its responsibilities and the structural organization as follows:

Article 1- the objective behind establishment of the council are drafting of rule of procedures, ordinances regulations, policies and rules aimed at supporting, supervising and guiding the design, manufacturing, export-import and distribution of toys and preventing unauthorized activities and gathering necessary information on the appropriate use of toys and giving notice and alarming the public on cases of possible dangers to safeguard public physical, mental and cultural and social wellbeing.

Article 2- Based on the article 8 of the Statute, the council is responsible to take following measure for expansion and promotion of toy industry:

  1. Coordination and improvement of planning in industrial and commercial sectors for creation of toys industry and improvement of its production standards and expansion of toy export.
  2. Providing special assistance for production of toys which have the potentials of competing in regional and international markets.
  3. Providing assistance to professional institutions and supporting both producers and consumers.
  4. Taking required measures for membership in regional Islamic and international unions.
  5. Coordination of national standards with international standards.

Article 3- the Council has a president, vice-president, a clerk and secretary.

Note 1: the vice president will be appointed by the president and upon the approval of the Council will serve a two years term of office.

Note 2: The secretary will be appointed by the decree of the Council's president but is not a Council member.

Note 3: The Council, when ever needed can seek views of scholars and experts in its meetings but such individuals will not have voting right.

Article 4- In absence of the president, the vice president will preside over the Council's meetings.

Article 5- The secretary is responsible for preparation of council's agenda, Inviting the Council's members to attend the meetings and sending the resolutions to the secretariat and affiliated departments.

Article 6- The meetings of the Council will be considered as official upon the attendance of the minimum number of the members.

Note: In case of 3 consecutive absence of a council member in Council's meeting, the case will be first brought up in the Council and then will be referred to the Council of Public Culture for appropriate decision.

Article 7 – The resolutions of the Council will be approved by the votes of 50 percent plus one of the attending members.

Article 8- Those members of the Council who are the representatives of other establishments are responsible for coordination of relationship between their concerned organizations and the Council and are obliged to submit a copy of all resolutions adopted in their organization in connection with council's activities to the secretariat of the Council.

Article 9- The resolutions adopted by the Council should be implemented by all governmental and private organizations and companies and any misconduct, based on Council's findings will be followed up through Judiciary.

Article 10- The Council is requested to submit its performance report in 6 months intervals to the Council for Public Culture.

Article 11- The Council, each year based on the recommendations of the Intellectual Promotion Center of Children and Young Adults will prepare a list of those toys that require license for manufacturing, import-export and inform the licese issuing authorities accordingly.

Article 12- The Council has a secretariat with following departments:

  • Department for research and drafting of regulations and procedures
  • Department for supervision and inspection and dealing with complaints and evaluation
  • Department for general affairs

Note 1: The secretariat of Council is structurally a sub-division of the Center for Intellectual promotion of Children and Young Adults and its structural sub-division should be ratified by the Administration and Employment Organization.

Note 2: The departments for research and drafting of regulations and procedures, supervision and complaint handling and evaluation and supervision and inspection each have their own commissions and the procedures for their formation, responsibilities and composition of their members are decided by the Council.

Article 13- The secretariat of the Council is responsible for drafting of the rules and procedures, registration of projects, issuing of production, import – Export license of toys and designation of standards for appropriate toys and referring them to the Council.

Article 14- According to article 5 of the Council's statutes, registration of projects and issuing of production and export–import licenses for toys are conducted by the Center for Intellectual Promotion of Children and Young Adults based on the rules and regulations adopted by the Council.

Note 1: Any complaint by the producers, importers or exporters of toys should be referred to the supervision and inspection department of the Council in writing and the secretary of the Council is required to refer the complaints to the Council and notify the concerned individuals or organization of the decisions made by the Council.

Note 2: The formalities for export-import of toys are based on the general rules and regulations of the Ministry of Commerce.

Note 3: All executive state departments that are required to provide facilities for export-import of toys should render their assistance only to those individuals who have obtained the license stated in this article.

Article 15- The Research and Rules and Regulations Department in order to obtain the latest know-how on toy manufacturing industry should conduct scientific research works. The said department will also organize seminars, roundtables and exhibitions aimed at promoting the knowledge and information of those active in toy production sector.

Note: This department through provision of facilities and assistances and by coordination with the research department of the Center will assist legal and real persons in their efforts to carry out research works or compile books and write scientific article on toy production.

Article 16 – The above mentioned department, based on articles 4 and 6 of the Council's statute should formulate the required rules and regulations in accordance and within the framework of the country's general rules and submit them to the Council for approval.

Article 17 – Following the approval and notification of rule for overseeing the design and manufacturing and export-import of toys, none of the country's executive departments is allowed to register and issues license for manufacturing and export – import of toys and manufacturers and private and governmental commercial entities that are involved in toy business, based on the adopted rules and regulation, should apply for license for their activities and any violation could be subject to legal action.

Note 1: The cultural and propagation organizations and mass media outlets are required not commercializing those toys which lack the production or export – import license.

Note 2: Ministries of Industries, Commerce, Customs Department and Standard Organization along with other concerned authorities are required to coordinate their rules and regulations concerning the issues related to provision of licenses for toys with the Council's secretariat.

Article 18- The supervision and inspection department is responsible for handling of complaints and overseeing the proper implementation of rules and regulations adopted by the Council and performs its duties through visits and inspections of toy production units both private and governmental, with cooperation of other departments of the Council's secretariat.

Note: In case the said department becomes across any violation of the Council's rules and regulation by the producers, after examining and reviewing the nature of the violation, will refer the case to the Council for decision making and later will inform the judicial authorities to take legal actions.

Article 19 – Handling all administrative and financial activities of the secretariat and making contacts and public relation responsibilities are assigned to the department of General Affairs.

Article 20 – The council's secretariat will pay salary and boned for its permanent staff and the council members and experts who attend various meetings of the Council or conduct research work, receive special fees based on the nature of their works.

Article 21 – The financial resources of the Council and the secretariat will be secured trough the Plan and Budget Organization and other legal resources upon the recommendation of the Center for Intellectual Promotion of Children and Young Adults.

Article 22 – This rule of procedures consists of an introduction, 22 articles and 14 notes and was adapted in the 341st meeting of the Council for Public Culture on Nov.8, 2000.
